Board of Zoning Appeals


The Board of Zoning Appeals (BZA) hears and decides appeals from any order, requirement, decision or determination made by an administrative officer in the administration or enforcement of this article or of any ordinance adopted pursuant thereto. The decision on such appeal shall be based on the BZA's judgment of whether the administrative officer was correct. The BZA shall consider the purpose and intent of any applicable ordinances, laws and regulations in making its decision; to authorize upon appeal or original application in specific cases such variance as defined in § 15.2-2201 from the terms of the ordinance as will not be contrary to the public interest, when, owing to special conditions a literal enforcement of the provisions will result in unnecessary hardship; provided that the spirit of the ordinance shall be observed and substantial justice done. Governed by Virginia Code Section 15.2-2308 and New Kent Code Section 98-1021.

Makeup: Composed of one Board-nominated/Court-appointed member from each election district and no more than 3 alternates. Must take oath of office before assuming position and with subsequent reappointments. Members must file a Conflict of Interest form upon appointment and annually thereafter.

Term: 5-year terms ending December 31, staggered so that one term expires each year.

Meeting Schedule: meets as needed in the County Administration Building.
